Pardevant le Notaire Public de la province du Bas Canada résidant au Cap Santé Baronnie et Comté de Portneuf, Soussignés et Témoins ci-après Nommés. Fut présent Sieur John Mehan, ancien Cultivateur demeurant en ladite paroisse du Cap Santé au lieu nommé Mont Kearny. Étant malade de corps, sain néanmoins d'Esprit, de mémoire, Jugement et entendement Ainsi qu'il est apparu auxdits notaire et Témoins sous-signés par ses paroles, discours et Maintient - Lequel considérant que toute la nature es sujette à la mort - qu'en ce monde il n'y a rien de si incertain que l'heure d'icelle (l'heure de celle-ci , sous-entend la mort )et ne Voulant pas en être prévenu avant que d'avoir mis ordre à ses affaires Spirituelles et Temporelles, en disposant du peu de Biens qu'il a plu à Dieu lui accorder ainsi qu'il lui est Loisible et permis par les Lois actuellement en force en cette province, a fait dicté et Nommé audit notaire soussigné, les dits Témoins présents son présent Testament et actes de dernière Volonté Ainsi qu'il suit:
- Premièrement, comme chrétien catholique et romain dans le sein de laquelle religion il désire vivre et mourir a recommandé son âme à Dieu suppliant sa Divine Bonté par les mérites de la passion de notre Seigneur Jésus-Christ, par l'intercession de la glorieuse Vierge Marie et St.John Son Patron, de lui faire miséricorde, lui pardonner ses péchés, de la placer au Royaume des cieux aux nombres des Bienheureux.
- Secondement, veut et ordonne ledit Sieur John Meehan, Testateur, que, avant toutes choses, ses dettes soient payées et Torts par lui faits si aucuns - se trouvent réparés par son Exécuteur Testamentaire ci-après nommé.
- Troisièmement, désire et ordonne ledit Testateur que son corps après son décès - soit inhumé en l'église et enterré en le cimetière de la paroisse où il décédera et quant aux pompes qu'il entend avoir- au jour de son décès, il s'en rapporte entièrement à la générosité et prudence de ses légataires ci- après nommés - le tout payé par chaque part et portion entr' eux.

Quatrièmement, donne et lègue ledit Testateur, au Sieur Patt Meehan, son fils ainé, tous les droits et prétentions que ledit Testateur a et peut avoir et prétendre dans - une terre de quatre arpens de front sur vingt - cinq arpens de profondeur, située en ladite paroisse de Cap Santé Baronnie de Portneuf. Étant le no 17 dans le cinquième rang qui sont concédés dans ladite Baronnie. Bornée pardevant - au chemin du Roi qui sépare la quatrième concession d'avec celle de la cinquième concession à par derrière au bout de sadite (sienne profondeur)profondeur de vingt-cinq arpens. Joignant d'un côté au Nord à une autre terre appartenant audit Testateur et ci- après, donner (sous-entendre donnée) à Nicholas Meehan, l'un de ses fils - et l'autre côté au sud - à une autre terre appartenant audit Testateur et ci-après donner (ée) à John Meehan, l'un de ses autres fils, circonstances et dépendances.
- Cinquièmement, donne et lègue ledit Sieur Testateur audit Sieur Nicholas Meehan - l'un de ses autres fils - tous les droits et prétentions que ledit Testateur a et peut prétendre et avoir - dans une terre de quatre arpens de front sur vingt-cinq arpens de profondeur- située en ladite paroisse du Cap Santé susdite Baronnie de Portneuf, dans le cinquième rang d'icelle paroisse Étant le No 18 dans le même rang. Bornée pardevant audit chemin qui sépare le quatrième et cinquième rang et par derrière - au bout de sadite profondeur, joignant d'un côté au Nord - aux héritiers - Georges White, et d'autre côté au Sud audit Patt Meehan, circonstances et dépendances.
- Sixièmement, donne et lègue ledit Sieur testateur au Sieur John Meehan, troisième de ses fils, tous les droits et prétentions que ledit testateur a et peut prétendre et avoir dans une terre de quatre arpens de front sur vingt-cinq arpens de profondeur - située en ladite paroisse du Cap Santé susdite Baronnie de Portneuf dans le cinquième rang d'icelle paroisse et Baronnie. Étant le No 16 dans le même rang - Bornée pardevant au chemin du Roy qui sépare le quatrième et cinquième rang de ladite paroisse et parderrière au bout de sadite profondeur, joignant d'un côté au Sud John Kingsborough et d'autre côté au Nord audit Patt Meehan son frère, avec ensemble des bâtiments dessus contruits circonstances et dépendances sans aucune réserve quelconques.
- Septièmement, et quant au résidu et surplus de tous ses biens - tant meubles que propres acquêts et conquêts immeubles, qui se trouveront lui appartenir au jour et heure de son décès en quelques lieux qu'ils soient et se trouveront dus assis* et situés et de quelque valeur et nature qu'ils puissent être sans aucune réserve quelconques, icelui dit Sieur Testateur les donne et lègue et laisse en pleine propriété par son présent testament au Sieur James Meehan, on fils demeurant avec lui en ladite paroisse du Cap Santé pour lui témoigner la bonne amitié qu'il a pour lui et afin qu'il se souvienne de lui dans ses prières. James Meehan ledit Testateur le fait et institue son légataire universel pour lesdits biens meubles et immeubles, à lui légué en jouir faire et disposer en toute propriété au jour du décès de lui dit testateur et à perpétuité comme de son propre et loyal acquêt au moyen du présent testament et voulant en outre que le présent testament soit exécuté à la lettre et sans aucune difficulté entre les légataires - Car tel est la volonté et intention dudit testateur.
- Déclare ledit testateur qu'il ne réserve rien par son présent testament à ses autres enfants attendu le peu de biens qu'il en a et qu'ils ne sont que suffisants pour le soutenir dansle déclain de ses jours.
- Et pour exécuter et accomplir le présent testament, ledit Sieur testateur John Meehan a nommé et élu pour son exécuteur testamentaire la personne du Sieur qu'il prie d'en prendre la peine et lui rendre ce dernier service d'amitié entre les mains duquel il se déssaisit de tous ses biens suivant la coutume.
Révoquant tous autres testaments et codiciles qu'il peut avoir fait avant le présent auquel seul il s'arrête comme étant sa dernière volonté. Ce fut ainsi fait et cité et nommé par ledit Testateur audit notaire soussigné lesdits témoins présents audit lieu du Cap Santé, maison et demeure dudit testateur, l'an mil huit cent trente huit, le neuvième jour du mois d'octobre, avant midi, en présence des Sieurs Michael Kearnay et William Mc Kaovan cultivateurs demeurant au Cap Santé, témoins pour ci exprès appelés qui ont signé avec nous dit notaire, après que le présent testament a été lu et relu par ledit notaire soussigné lesdits témoins présents audit testateur qui a dit l'avoir bien entendre et comprendre après qu'il lui a été bien et duement expliqué par ledit notaire et les témoins soussignés et y persiste comme étant sa dernière volonté déclarant ne pouvoir signer comme étant trop malade de ce qn quoi lecture faite et refaite en présence desdits témoins et trois renvois en marge valide dix mots rayés sont nuls.

In front of the notary public of the province of lower Canada resident of Cap Santé, Barony and County of Portneuf, undersigned and witnesses named below.
Was presented Sir John Meehan, old farmer residing in said parish of Cap Santé, in place of was named Mont Kearny (Michael Kearney?). Being sick in body, healthy nevertheless of spirit, memory, judgement and understanding thus it appeared known to the undersigned notary and witnesses by his words, speech and bearing – which considering that all of nature is subject to death – there is nothing so uncertain as the hour of death and not wanting to be prevented of it before having put in order his spiritual and temporal affairs, and being disposed of few goods of which it has pleased God to grant him as well as it is permissible and allowed by the actual laws in force in this province, has dictated and named to that undersigned notary, the said witnesses present his present last will and testament as follows:
Firstly, as a Roman Catholic Christian in the heart of which religion he desires to live and die, he commends his soul to God, beseeching His Divine mercy by the merits of the passion of our Savior Jesus Christ, by the intercession of the glorious Virgin Mary and St. John, his patron, give mercy to him, pardon his sins, and place him in the kingdom of heaven numbered among the blessed.
Secondly, wanted and ordained by said Sir John Meehan, testator, that, before all things, his debts be paid and wrongs that he made, if not repaired by himself, by his executor below named.
Thirdly, desired and ordained by the testator that his body after his death – be buried in the church and interred in the cemetery of the parish where he will die and as for ceremonies that he intends to have – on the day of his death, he refers the entirety to the generosity and prudence of his legatees below named – it all to be paid each part and portion between themselves.

Fourthly, given and bequeathed by said testator, to Sir Patt Meehan, his eldest son, all the rights and claims that said testator has and can have and claim in – one ground of 4 acres abreast by 25 acres of depth, situated in the aforementioned parish of Cap Santé, Barony of Portneuf. Being No. 17 in the 5th range which was conceded in the aforementioned Barony. Limited in the front by King’s road which separates the 4th concession with this the 5th concession from the rear at the end of the said depth of 25 acres. Joining on the one side to the north by one other ground belonging to said testator and below, given to Nicholas Meehan, one of his sons – and on the other side to the south – one other ground belonging to said testator and below given to John Meehan, one of his other sons, circumstances and dependencies.
Fifthly, given and bequeathed by said Sir Testator to said Sir Nicholas Meehan – one of his other sons – all the rights and claims that said testator has and can claim and have in one ground of 4 acres abreast in front by 25 acres of depth – situated in the aforementioned parish of Cap Santé, said Barony of Portneuf, in the 5th range of this parish being No. 18 in the same range. Limited in the front by said street which separates the 4th and 5th range and from the rear at the end of said depth, joining on the one side to the North, - with the heritors – George White, and to the other side to the south with said Patt Meehan, circumstances and dependencies.
Sixthly, given and bequeathed by said testator to Sir John Meehan, third of his sons, all the rights and claims that the said testator has and can claim and have in one ground of 4 acres in front by 25 acres of depth – situated in the said parish of Cap Santé said Barony of Portneuf in the 5th range of this parish and Barony. Being No. 16 in the same range – limited in front by King’s street which separates the 4th and 5th range of said parish and in the rear at the end of said depth, joining on the one side to the south John Kingsborough and on the other side to the north with said Patt Meehan, his brother, together with the buildings constructed above circumstances and dependencies without any reservation whatever.
Seventhly regarding the residue and surplus of all his goods – moveable and immoveable, wherever they may be at the day and hour of his death, without any reserve whatsoever, here said Sir Testator gives to them, bequeaths and leaves in freehold property by his present will to Sir James Meehan, his son living with him in the aforementioned parish of Cap Santé in order to show him the good friendship he has for him and so that he will himself remember him in his prayers. James Meehan by the said testator is made and instituted as residuary legatee for the said moveable and immovable goods, bequeaths him to enjoy and dispose of all property from the day of the death of said testator and in perpetuity as the proper and fair acquisition by means of the present will and wants moreover that the present will be carried out to the letter and without difficulty between the legatees – because it is the will and intention of said testator.

Declares said testator that he reserves nothing by his present will for his other children considering the few goods he has and that they are not sufficient to sustain him in the remainder of his days.
And for execution and accomplishment of the present will
the said Sir Testator John Meehan has named and elected for his executor the
person of Sir Michael Kearney undersigned that he prays that he himself
wants to take the trouble and render him this service of friendship into his
hands in which he relinquishes all his goods according to the custom.

Revoking all other wills and codices that he may have made before the present by which he alone stops as being his last will. It is thus done, dictated and named by the said testator by said undersigned notary aforesaid witnesses present at said place of Cap Santé, home and residence of said testator, the year 1838, the 9th day of the month of October, before mid-day, in the presence of Sirs Michael Kearney and William McKewan, farmers living in Cap Santé, witnesses for this called who have signed with us said notary, after which the present will was read and re-read by the said undersigned notary, the said witnesses present to that the testator who said he well heard and understood after which it was to him well and duly explained by the said notary and the undersigned witnesses and persists it as being his last will declared he could not sign as being very sick ?? reading was made and remade in the presence of said witnesses and refer to three in the valid margin ten words struck out are null.
