Pardevant le Notaire Public de la Province du Bas Canada, résident au Cap Santé Baronnie de Portneuf---sous-signés et témoins ci-après nommés-----
Fut présente Dame Brigitte White, veuve de feu John Meehan, demeurante en ladite paroisse de Cap Santé dans le comté de Portneuf. Étant malade de corps, saine néanmoins d'esprit et de mémoire, jugement et entendement ainsi qu'il est apparu auxdits Notaires et Témoins sous-signés, par ses paroles, discours et maintiens. Laquelle considérant que toute la nature est sujette à la mort--qu'en ce monde il n'y a rien de si incertain que l'heure d'icelle et ne voulant pas en être prévenu avant que d'avoir mis ordre à ses affaires spirituelles et temporelles, en disposant du peu de biens qu'il a plu à Dieu lui accorder ainsi qu'il lui est loisible et permis par les Lois actuellement en force en cette province, a fait dicté et nommé audit notaire sous-signé et lesdits Témoins --présents, son présent testament et acte de dernière volonté ainsi qu'il suit:
Premièrement, comme chrétienne catholique, apostolique et romaine dans le sein de laquelle religion elle désire vivre et mourir a recommandé son âme à Dieu suppliant sa Divine Bonté par les mérites de la Passion de Notre-Seigneur Jésus-Christ et par
l'intercession de la glorieuse Vierge Marie et Sainte Brigitte, sa patronne, et detout les Saints et Saintes de la Cour Céleste de lui faire miséricorde, lui pardonner ses péchés, et la placer au Royaume des Cieux au nombre des Bienheureux. Ainsi soit-il.
Secondement, veut et ordonne- ladite Dame Brigitte White Testatrice--que avant toutes choses, ses dettes soient payées et torts par elle faits si aucuns se trouvent réparés par son Exécuteur Testamentaire ci-après nommé.
Troisièmement, désire et ordonne ladite Dame Testatrice, que son corps après son décès soit inhumé en l'église de la paroisse où elle décédera et enterré en le cimetière de ladite paroisse et quant aux pompes et funérailles qu'elle entend avoir après son décès, elle s'en rapporte entièrement à la prudence et discrétion de son Exécuteur Testamentaire ci-après nommé.
Quatrièmement, donne et lègue ladite Dame Testatrice, au Sieur Patt Meehan, son fils ainé, tous les droits et prétentions que ladite Testatrice a et peut avoir et prétendre dans et sur une terre de quatre arpens de front sur vingt-cinq arpens de profondeur sise et située dans ladite paroisse du Cap Santé susdite Baronnie de Portneuf- étant le No 17 dans le cinquième rang des terres qui sont concédées dans ladite Baronnie de Portneuf. Bornée pardevant au chemin du Roi qui sépare la quatrième et cinquième concession et parderrière au bout de ladite profondeur joignant d'un côté au Nord à une autre terre qui appartient pour moitié à ladite Testatrice et ci-après donnée à Nicholas Meehan l'un de ses fils et l'autre côté au Sud à une autre terre qui appartient pour moitié à ladite testatrice et ci-après donnée à John Meehan, l'un de ses fils- circonstances et dépendances---
Cinquièmement, donne et lègue ladite Testatrice audit Sieur Nicholas Meehan, l'un de ses autres fils-- tous les droits et prétentions que laditeDame Testatrice a et peut avoir et prétendre dans et sur une terre de quatre arpens de front sur vingt-cinq arpens de profondeur sise et située en ladite paroisse du Cap Santé susdite Baronnie de Portneuf, dans le cinquième rang des terres de ladite Baronnie de Portneuf--étant le No 18 dans le même rang- Bornée pardevant audit chemin du Roi qui sépare le quatrième d'avec le cinquième rang et parderrière au bout de sadite profondeur joignant d'un côté au Nord aux héritiers--Georges White--et l'autre côté au Sud audit Patt Meehan--circonstances et dépendances.
Sixièmement, donne et lègue ladite Dame Testatrice, au Sieur John Meehan, troisième de ses fils-- tous les droits et prétentions que ladite Dame Testatrice a et peut avoir dans et sur une terre de quatre arpens de front sur vingt-cinq arpens de profondeur, située en ladite paroisse de Cap Santé susdite Baronnie de Portneuf, dans le cinquième rang des terres d'icelle paroisse et Baronnie--étant le No 16 dans cette même concession - Bornée pardevant audit chemin royal qui sépare le quatrième d'avec le cinquième rang des terres de ladite paroisse, et, parderrière au bout de sadite profondeur, joignant d'un côté au Nord audit Patt Meehan et d'autre côté au Sud à John Kingsborough-- avec l'ensemble des bâtiments dessus construits circontances et dépendances sans aucune réserve quelconque.
Septièmement, Et quant au résidu et surplus de tous ses autres biens tant meubles que propres acquets et conquêts immeubles qui se trouveront à lui appartenir au jour et heure de son décès, en quelques lieux qu'ils soient et se trouveront dus, assis* et situés et de quelques valeur et natures qu'ils puissent être sans aucune réserve quelconques -- icelle dite Dame Testatrice les donne, lègue et laisse en pleine propriété par son présent testament au Sieur Dennis Kenny et à Dame Helainne*-------Meehan, ses gendre et fille demeurant tous deux avec elle en ladite paroisse du Cap Santé pour leur témoigner la bonne amitié qu'elle a pour eux et afin qu'ils se souviennent d'elle dans leurs prières.
Lesquels dits Sieur et Dame Dennis Kenny ladite Dame Testatrice en fait et institue ses légataires universels pour----- desdits biens, meubles et immeubles--suslégués en jouir faire et disposer en toute propriété au jour du décès de ladite Testatrice et à perpétuité comme de leur propre et loyal acquet au moyen du présent testament nonobstant toutes lois usages et coutumes au contraire. Voulant en outre ladite Testatrice que son présent testament soit exécuté à la lettre sans aucune difficulté entre lesdits légataires car tell est la volonté et intention de ladite Testatrice.
Déclare ladite Dame Testatrice qu'elle ne réserve rien par son présent testament à ses autres enfants attendu que le peu de biens qu'elle a ne sont que suffisants pour la soutenir dans le déclain de ses jours.
Et pour exécuter et accomplir le présent testament, ladite Dame Testatrice a nommé et élu pour son exécuteur testamentaire la personne dudit Sieur Dennis Kenny, son gendre, qu'elle prie de vouloir en prendre la peine de lui rendre se service d'amitié entre les mains duquel-elle se dessaisit de tous ses biens suivant la coutume.
Révoquant tous autres testaments et codiciles qu'elle peut avoir fait avant le présent auquel seul Elle s'arrête comme étant sa dernière volonté. Ce fut ainsi fait, dicté et nommé par ladite Testatrice audit Notaire sous-signés et lesdits témoins présents audit lieu du Cap Santé, maison dudit Kenny où réside ladite Testatrice, l'an mil huit cent trente neuf, le septième jour du mois de mai, avant midi, en présence des Sieurs George Buist Me menuisier demeurant en ladite paroisse du Cap Santé et Louis Marcotte navigateur demeurant ordinairement à Deschambault témoins pour ce appelés desquels ledit Sieur Buist a signé avec nous ditnotaire après que le présent testament a été lu et relu et expliqué à ladite Testatrice par ledit Sieur Buist l'un des témoins et ledit notaire sous-signé l'autre témoin présent à ladite Testatrice qui a déclaré le bien entendre et comprendre et y a persisté comme étant sa dernière volonté en déclarant et ainsi que l'autre témoin ne savoir écrire ni signer de ce en quoi lecture faite et refaite.

In front of the notary public of the province of lower Canada, resident of Cap Santé, Barony of Portneuf –undersigned and witnesses named below ----
Was presented Lady Brigitte White, widow of the late John Meehan, resident of the aforementioned parish of Cap Santé in the county of Portneuf. Being sick of body, healthy, nevertheless, of spirit and memory, judgement and understanding, thus it appeared known to the notaries and undersigned witnesses by her words, speech and bearing. Which considering that all of nature is subject to death—when in this world there is nothing so uncertain as the hour of death and not wanting to be forestalled? before having put in order her spiritual and temporal affairs, and being disposed of few goods, of which it pleased God to grant her, as well as it is permissible and allowed by the actual laws in force in this province, has dictated and named to that undersigned notary and the aforementioned witnesses --- presents, her present last will and testament as follows:
First as a Catholic Christian, apostolic and roman, in the heart of which religion she wishes to live and die, she commends her soul to God beseeching his Divine mercy by the merits of the Passion of our Savior Jesus Christ and by the intercession of the glorious Virgin Mary and Saint Brigitte, her patron, and with all the Saints and Saints of the heavenly court, give mercy to her, pardon her sins and sit her in the kingdom of heaven numbered among the blessed. Thus it is.
Secondly, wanted and commanded – the aforementioned Lady Brigitte White, testatrix, that before all things, her debts are to be paid and wrongs made by her, if any are found, are to be repaired by her executor named below.
Thirdly, desired and ordained by the aforementioned lady testatrix, that her body after her death be buried at the church of the parish where she will die and interred in the cemetery of the aforesaid parish and as for ceremonies and funerals the she intends to have after her death she refers the entirety to the prudence and discretion of her executor below named.
Fourthly, given and bequeathed by the aforementioned lady testatrix, to Sir Patt Meehan, her eldest son, all the rights and claims that the aforementioned testatrix has and can have and claim in and on a ground of four acres abreast of 25 acres of depth located and situated in the aforementioned parish of Cap Santé, aforementioned Barony of Portneuf- being number 17 in the 5th range of lands which are conceded in the aforementioned Barony of Portneuf. Limited in front of King’s road that separates the 4th and 5th concession and from the rear at the end of the aforementioned depth joining on one side to the north with another ground, half of which belongs to the aforementioned testatrix and hereafter given to Nicholas Meehan, one of her sons and on the other side, to the south, with another ground, half of which belongs to the aforementioned testatrix and hereafter given to John Meehan, one of her sons, circumstances and dependencies---
Fifthly, given and bequeathed by the aforementioned testatrix to that Sir Nicholas Meehan, one of her other sons—all the rights and privileges that the aforementioned lady testatrix has and can have and claim in and on one ground of 4 acres abreast on 25 acres of depth and situated in the aforementioned parish of Cap Santé, aforesaid Barony of Portneuf, in the 4th range of land of the aforementioned Barony of Portneuf---being number 18 in the same row- limited by aforesaid King’s road that separates the 4th with the 5th range and from the rear at the end of said depth joining one side to the north with the heirs – George White – and the other side in the south to that of Patt Meehan – circumstances and dependencies.
Sixthly, given and bequeathed by the aforementioned lady testatrix, to Sir John Meehan, third of her sons, all the rights and privileges that the aforementioned lady testatrix has and can have in and on a ground of 4 acres abreast by 25 acres of depth, situated in the aforementioned parish of Cap Santé, aforesaid Barony of Portneuf, in the 5th range of land of this parish and Barony---being the number 16 in this same concession – limited by aforesaid royal street (King’s road) which separates the 4th and 5th range of lands of the aforesaid parish, and from the rear at the end of the said depth, joining on the one side to the north with Patt Meehan and the other side to the south of John Kingsborough—together with the buildings constructed upon circumstances and dependencies without any reservations whatever.
Seventhly, regarding the residue of her property, moveable and immoveable, where ever they may be on the day and hour of her death, without any reservation, this said lady testatrix gives them, bequeaths and leaves in freehold property by her present will to Sir Dennis Kenny and to Miss Helene ------Meehan, her son-in-law and daughter, both of them living with her in the aforementioned parish of Cap Santé, in order to show them the good friendship that she has for them and so that they themselves will remember her in their prayers.
Who said Sir and Mrs. Dennis Kenny aforementioned lady testatrix makes and appoints her residuary legatees for ---- aforesaid goods, moveable and immoveable—bequeaths them to enjoy and use all property from the day of the death of the aforementioned lady testatrix in perpetuity as the proper and fair acquisition of them by means of the present will notwithstanding all laws of usage and customs to the contrary. Wanting moreover the aforesaid lady testatrix that her present will be carried out to the letter without any difficulty between the aforesaid legatees because it is the will and intention of the lady testatrix.
Declares the aforementioned lady testatrix that she reserves nothing by her present will for her other children for the reason that the little goods that she has are only sufficient to support her in the remainder of her days.
And for execution and accomplishment of the present will, the aforementioned lady testatrix names and elects for her executor the person of the aforesaid Sir Dennis Kenny, her son-in-law, that she prays he wants to take the trouble to render her the service of friendship into his hands in which she relinquishes all of her goods according to the custom.
Revoking all other wills and codices that she may have made before the present by which she alone stops? as being her last will. It thus is done, dictated and named by the aforementioned lady testatrix by said undersigned notary and aforesaid witnesses present at said place of Cap Santé, house of said Kenny where resides the aforementioned lady testatrix, the year of 1839, the 7th day of the month of May, before mid-day, in the presence of Sirs George Buist, carpenter living in aforesaid parish of Cap Santé and Louis Marcotte, sailor ordinarily living in Deschambault, witnesses for this called for which the said Sir Buist signed with us said notary after this the present will was read and re-read and explained to the aforementioned testatrix by the said Sir Buist, one of the witnesses, and the said undersigned notary. The other witness present with said testatrix who declared she well heard and understood and persisted as being her last will and testament and thus that the other witness did not know how to write or sign with these in what reading was made and remade.
